1. Introduction

These Terms of Use ("Terms") govern your use of the Body Map app ("App") and any printed materials ("Printed Materials") sold or distributed by us, including but not limited to posters and other visual content. By using the App or purchasing or using the Printed Materials, you agree to these Terms. If you do not agree, you must not use the App or the Printed Materials.

Use of the Body Map app is also governed by Apple’s Licensed Application End User License Agreement (EULA). By downloading the app from the App Store, you agree to be bound by the terms of Apple’s EULA in addition to these Terms of Use.

2. No Medical Advice

The information provided in the App and the Printed Materials is for general informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

3. Use at Your Own Risk

You acknowledge that your use of the App, reliance on any content within it, or use of the Printed Materials is entirely at your own risk. The content is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to accuracy, completeness, reliability, or suitability for any particular purpose.

4. No Liability for Accuracy

While we strive to ensure the content in the App and Printed Materials is accurate and up to date, we make no representations or warranties regarding its accuracy, completeness, or reliability. We accept no liability for any errors, omissions, or outdated information contained in the App or Printed Materials.

5. Printed Materials Updates

We regularly update and improve our maps. As a result, the content of Printed Materials may change between editions. The first printed edition may differ from later versions, and we do not guarantee consistency across print runs. By purchasing or using the Printed Materials, you acknowledge that future editions may include modifications, additions, or refinements.

6. No Liability for Consequences

To the fullest extent permitted by law, we shall not be liable for any loss, damage, injury, or other consequence arising from your use of or reliance on the content of the App or Printed Materials. This includes, but is not limited to, indirect, incidental, consequential, or special damages.

7. Third-Party Links and Content

The App contains content sourced from Wikipedia, a third-party website. Wikipedia content is licensed under the Creative Commons Attribution-ShareAlike 4.0 License (CC BY-SA 4.0), and appropriate attribution is provided in accordance with that license. We do not claim ownership of Wikipedia content and provide links to the original articles where applicable.

We are not responsible for the accuracy or completeness of third-party content and disclaim any liability arising from its use.

8. Ask Bones (AI Assistant)

a. Use of OpenAI API
The Bones feature of the App (“Ask Bones”) is powered by the OpenAI API, a third-party service. When you submit a question, the text of your query is transmitted to OpenAI’s servers in order to generate a response.

b. No Personal Data
You must not enter personal, sensitive, or identifying information into the Bones feature. Queries are processed solely to provide the Bones functionality and are not retained or linked by us to your identity.

c. Accuracy of Responses
AI-generated responses may be inaccurate, incomplete, or misleading. They are provided for general informational purposes only and are not a substitute for professional medical advice. Always consult a qualified healthcare provider for medical concerns.

d. Limitation of Liability
To the fullest extent permitted by law, we disclaim liability for any consequences arising from your use of or reliance on the Bones feature, including errors or inaccuracies in AI-generated responses.

9. Subscriptions & Payments (app)

a. Subscription Access
Certain map layers and features of the App are available only through a paid subscription ("Subscription"). By purchasing a Subscription, you gain access to additional layers and content as specified at the time of purchase.

b. Billing & Payment
Subscriptions are billed on a recurring basis (e.g., monthly or annually) as stated at the time of purchase. You will be billed through the App Store and subject to their respective terms and conditions.

c. Free & Paid Content
Some layers of the map are available for free, while others require a paid Subscription. We reserve the right to change the content available under free or paid access at any time.

d. Auto-Renewal
Unless cancelled, your Subscription will automatically renew at the end of each billing cycle. You can manage or cancel your Subscription at any time through your account settings in the App Store.

e. Refunds & Cancellations
Refunds for in-app purchases are handled by the App Store. Please refer to their respective refund policies.

f. Price Changes
Price changes for Subscriptions are subject to App Store policies, and you will be notified in advance if a change affects your renewal.

10. Returns & Refunds (Printed Materials)

a. Order Cancellations
Orders for Printed Materials can only be cancelled before they enter production. Once an order has entered production, we cannot guarantee cancellation, and you will be charged for the product costs.

b. No Returns for Unwanted Items
All Printed Materials are made-to-order and are considered bespoke items. As such, they are not eligible for returns or refunds unless there is a defect with the product.

c. Damaged or Incorrect Items
If you receive a defective or incorrect item, please contact us at info@bodymap.shop with details and photos of the issue. We will work with our print provider to resolve the problem, which may include a replacement or refund at our discretion.

d. Incorrect Shipping Address
It is your responsibility to provide the correct shipping address when placing an order. If an order is returned due to an incorrect address, we will contact you to arrange re-shipment at your cost. If the package is not returned, a new order will need to be placed.

e. Refund Processing
Refunds, when applicable, will be processed back to the original payment method. Processing times may vary depending on your payment provider.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the App or purchase and use of Printed Materials after any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Apple-Specific Terms

This End User License Agreement (EULA) is between you and the developer of the Body Map app, not Apple. The developer, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not modify or override the Apple Media Services Terms and Conditions.

a. Scope of License
Your license is limited to a non-transferable right to use the Licensed Application on Apple-branded devices you own or control, as permitted by Apple’s Usage Rules and applicable terms, including Family Sharing.

b. Maintenance and Support
The developer is responsible for providing maintenance and support for the app. Apple has no obligation to provide any support or maintenance services for the Licensed Application.

c. Warranty and Refunds
In the event of a failure of the app to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses arising from failure to conform to any warranty are the sole responsibility of the developer.

d. Product Claims
The developer is responsible for addressing any claims by you or third parties relating to the app, including but not limited to: product liability claims, legal compliance, and claims under consumer protection or privacy laws.

e. Intellectual Property
In the event of any third-party claim that the app or your use of it infringes intellectual property rights, the developer, not Apple, is responsible for investigating, defending, settling, and discharging such claims.

f. Legal Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties.

h. Third-Party Terms
You agree to comply with any applicable third-party terms of agreement when using the app.

i. Apple as Third-Party Beneficiary
You and the developer acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and Apple has the right to enforce it against you as such.
